www.healthvollet.com is webApp or website or mobile application termed as (“APP”) owned and operated by “Globewell Health Tourism Private Limited” termed as (“COMPANY” or “Healthvollet”) which provides medical services(termed as “Medical Services”) and facilitates to users (“You”, “User”, “Patient” , “Consumer” ) through our “APP” directly or through registered Medical Practitioners, Doctors, Diagnostic Centers, Hospitals or any entity (collectively termed as “Medical Practitioners” ) directly or indirectly connected to medical treatment or facilitations or services.
1. Applicability of Terms :1.1) The terms and conditions as mentioned in this agreement under which you are allowed to use the Website and describe the manner in which we shall treat your account while you are registered as a member with us. If you have any questions about any part of the Agreement, feel free to contact us at care@healthvollet.com.
1.2) We reserve the right to change this policy at any given time, of which you will be promptly updated. If you want to make sure that you are up to date with the latest changes, we advise you to frequently visit this page.
1.3) By accessing, browsing or in any way transacting on the Website, or availing any Services, You accept these Terms of Use. Further, by impliedly or expressly accepting these Terms of Use, you also accept and agree to be bound by Our policies, including the Privacy Policy and such other rules, guidelines, policies, terms and conditions as are relevant under the applicable law(s) in India and other jurisdictions for the purposes of accessing, browsing or transacting on the Website, or availing any of the Services, and such rules, guidelines, policies, terms and conditions shall be deemed to be incorporated into, and considered as part and parcel of these Terms of Use.
1.4) Our website contains links that lead to other third party websites. If you click on these links HealthVollet is not held responsible for your data and privacy protection. Visiting those websites is not governed by this privacy policy agreement. Make sure to read the privacy policy documentation of the website you go to from our website.
1,5) This Agreement is governed by the provisions of Indian law, including but not limited to:
i. the Indian Contract Act, 1872,
ii. the (Indian) Information Technology Act, 2000, and
iii. the rules, regulations, guidelines and clarifications framed there under, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”).
1.5) These Terms of Use constitute an electronic record in terms of the IT Act and rules framed there under, as applicable and amended from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.
2. ELIGIBILITY
2.1) You agree and acknowledge that you attain age of 18 years or older to register, use the Services, or visit or access the “APP” by entering and updating accurate and true information as required by APP.
2.1) Once you agree to allow our website to use cookies, you also agree to use the data it collects regarding your online behavior (analyze web traffic, web pages you spend the most time on, and websites you visit).The data we collect by using cookies is used to customize our website to your needs. After we use the data for statistical analysis, the data is completely removed from our systems.
3. TERMS OF USE SPECFIC TO ALL USERS (EXCEPT MEDICAL PRACTITIONERS)
The below terms are applicable only to Users other than Medical Practitioners.
3.1 USER ACCOUNT AND DATA PRIVACY
3.1.1 The terms “personal information” and “sensitive personal data or information” are defined under the SPI Rules, and are reproduced in the Privacy Policy.
3.1.2 By this terms “USERS” allows is to have access to registered Users’ personal email or phone number, for communication purpose so as to provide you a better way of booking appointments and for obtaining feedback in relation to the Medical Practitioners and their practice.
3.1.3 The Privacy Policy defines:
1. The type of information collected from Users, including sensitive personal data or information;
The purpose, means and modes of usage of such information;
2. Other information specified by the SPI Rules.
3.1.5 The User is expected to read and understand the Privacy Policy, so as to ensure that he or she has the knowledge of, inter-alia:
1. the fact that certain information is being collected from User;
2. the purpose for which the information is being collected;
3. the intended recipients of the information;
4. the nature of collection and retention of the information; and
5. the name and address of the entity that is collecting the information and the entity that will retain the information; and
3.1.6 Healthvollet shall not be responsible in any manner for the authenticity of the personal information or sensitive personal data or information as entered by the User in “APP”.
3.1.7 The User is responsible for maintaining and usage of the confidentiality of the User’s account credentials such as Login id and password, if the User is registered on the Website. In case of any misuse or suspected unauthorized use of the User’s account or password, User will immediately contact Healthvollet in written by email . Although Healthvollet will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of Healthvollet or such other parties as the case may be, due to any unauthorized use of your account.
3.1.8 In case, If a User provides any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or Healthvollet or Medical Practitioners could find that such information is not authenticated, untrue, inaccurate, not current or incomplete, Healthvollet has the right to discontinue the Services and stop the access to the User at its sole discretion.
3.2 Medical Practitioners’ and Users’ information on APP
3.2.1 Information displayed on APP about Medical specialization, qualification, Experience, Expertise fees, location, Schedules, and similar details are updated by Medical Practitioners’. Healthvollet takes utmost care to ensure that such information is updated at frequent intervals. Although Healthvollet screens and vets the information and photos submitted by the Medical Practitioners, it cannot be held liable for any inaccuracies or incompleteness represented from it, despite such reasonable efforts.
3.2.3 APPOINTMENT BOOKING AND CONSULTATION
Healthvollet provides facility to Users to schedule consultation Medical Practitioners with :
a) Booking personal appointment through App; b)Booking Online Video Consultation though App.
Healthvollet will ensure Users are provided confirmed appointment on the Appointment Booking. However, Healthvollet has no liability if such an appointment is later cancelled by the Medical Practitioner, or the same Practitioner is not available for appointment.
In case of Online Consultation, Video or Telephonic, Healthvollet reserves the right to share the information provided by the User with the Medical Practitioner and store such information and/or conversation of the User with the Practitioner, in accordance with our Privacy Policy.
3.2.4 Without prejudice to the generality of the above, Healthvollet is not involved in providing any healthcare or medical advice or treatment or diagnosis and hence is not responsible for any interactions between User and the Medical Practitioner. User understands and agrees that Healthvollet will not be liable for:
1. User interactions and associated issues User has with the Practitioner;
2. the ability or intent of the Medical Practitioner(s) or the lack of it, in fulfilling their obligations towards Users;
3. any wrong medication or quality of treatment being given by the Medical Practitioner(s), or any medical negligence on part of the Medical Practitioner(s);
4. inappropriate treatment, or similar difficulties or any type of inconvenience suffered by the User due to a failure on the part of the Medical Practitioner to provide agreed Services;
5. any misconduct or inappropriate behavior by the Medical Practitioner or the Medical Practitioner’s staff;
3.2.4 Users are allowed to provide feedback about their experiences with the Practitioner, however, the User shall ensure that, the same is provided in accordance with applicable law. User however understands that, Healthvollet shall not be obliged to act in such manner as may be required to give effect to the content of Users feedback, such as suggestions for delisting of a particular Practitioner from the Website.
3.2.5 In case of a ‘Patient-No-Show (P.N.S)’ or User Who has booked appointment through Healthvollet App and not come either online or personal Visit without any valid reason, Healthvollet reserves the right to take appropriate actions for operation of User Account.
3.4.7 Cancellation and Refund Policy
1. In case of Appointment Booking through our APP for Medical Consultation with Online pre- payment, If Medical Practitioner has not been able to meet for Consultation, User, User can write to us at support@healthvollet.com within five (5) days from the date of appointment , User will be refunded the entire consultation amount as mentioned on the Website will be refunded to the User within the next five (5) to six (6) business days in the original mode of payment done by the User while booking.
2. In case where the User, does not show up for the appointment booked with a Medical Practitioner, without cancelling the appointment 24 hour in advance, the amount will not be refunded. However, where cancellation charges have been levied (as charged by the Medical Practitioner/Practice), User will not be entitled to refund even if User has cancelled beforehand.
3. Users will not be entitled for any refunds in cases where, the Medical Practitioner is unable to meet the User at the exact time of the scheduled appointment time and the User is required to wait, irrespective of the fact whether the User is required to wait or choose to not obtain the medical services from the said Practitioner.
3.4.8 Medical Practitioners’ information
Information provided on APP such as Medical Practitioners’ profile, data, Image , facilities, treatment or any such information (collectively, “Information”) are provided by Medical Practitioners or related persons. Such Information are provided to assist you with locating appropriate medical care from a qualified practitioner and vicinity of location. It does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition.
3.4.9 It is hereby expressly clarified that, the Information that you obtain or receive from Healthvollet, and its employees, contractors, partners, sponsors, advertisers, licensors or otherwise on the APP is for informational purposes only. We make no guarantees, representations or warranties, whether expressed or implied, with respect to professional qualifications, quality of work, expertise or other information provided on the Website. In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on such information.
3.5.1 The Information or Services are not intended to be a substitute for getting in touch with emergency healthcare. If you are an End-User facing a medical emergency (either on your or a another person’s behalf), please contact an ambulance service or hospital directly.
4 Terms for use of the Online Doctor Consultancy Services:
1 You acknowledge that the e-prescription which may be issued by the medical expert(s), in certain cases, is not be a valid prescription under applicable law(s) of India and may not be used for dispensation of medicines by any pharmacist including the Third Party Pharmacies.
3. Healthvollet is platform to connect Users with various segments of Medical Practitioners to avail prompt and expert medical advices and treatments . These advices and decisions are absolutely Your discretion based on the advice You receive from Your doctor or other professional Medical Practitioners about Your health.
4. Healthvollet (the owners and the employee staff of Healthvollet), Medical Practitioners and third-party professionals who offer the Services through the APP accept no responsibility for any medical, legal or financial events or outcomes related to the Services availed through the use of the App.
5. Healthvollet makes no warranty for any Medical Services or data or free. This includes loss of data or any service interruption caused by Healthvollet employees, APP or any such un expected occurrence. Healthvollet is not responsible for transmission errors, corruption of data.
6. Services on Healthvollet App is for personal use only and right to use the Services is not transferable.
7. Notwithstanding anything to the contrary contained herein, User alone shall be liable for User’s decisions, dealings and interaction with patients or Medical Practitioners’ (as the case may be) contacted or managed through the App and Healthvollet shall have no liability or responsibility in any ways. Healthvollet does not guarantee or make any representation with respect to the correctness, completeness or accuracy of the Information or detail provided by such client, patient, User, Medical Practitioners or any third party through the App. The Services should not be used for emergency treatment or medical services.
5. Payment, Fees and Taxes:
1. Diagnostic or Health Package Each User or Medical Practitioner or Third Party Diagnostic Service Providers are solely responsible for payment of all taxes, legal compliances, statutory registrations and reporting. Healthvollet is in no way responsible for any of the taxes.
2. The subscription fees for the Services, if any charged by Healthvollet, could be paid online through the facility made on the APP alongwth third party fees for processing online payment. All fees are exclusive of applicable taxes.
3. Healthvollet reserves the right to modify the fee structure by providing on the APP which shall be considered as valid and agreed communication.
4. Healthvollet might require details of User’s/ Third Party Service Providers’ bank account, credit card number etc.to process online payment . Please check Our Privacy Policy on how Healthvollet uses the confidential information provided by Users.
5. Payment methods for online payments : Wallets: Paytm, AmazonPay, Mobikwik, AirtelMoney, Freecharge, OlaMoney, JIO Money, PhonePe, MPESA UPI – BHIM and GooglePay. All debit and credit cards. Cash on delivery for offline payments.
6. Applicable payment charges: As actual or as per plan.

8. Indemnity
The Covenanters agree to defend, indemnify and hold harmless Healthvollet, the Protected Entities, independent contractors, service providers, consultants, licensors, agents, and representatives, and each of their respective directors, officers and employees, from and against any and all claims, losses, liability, damages, and/or costs (including, but not limited to, reasonable attorney fees and costs) arising from or related to (a) Covenanters access to or use of Website; (b) Covenanters violation of these Terms of Use or any applicable law(s); (c) Covenanters violation of any rights of another person/ entity, including infringement of their intellectual property rights; or (d) Covenanters conduct in connection with the Website.
9. Intellectual property rights
All the intellectual property used on the Website except those which have been identified as the intellectual properties of the Other Parties shall remain the exclusive property of the Company. The Other Parties agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any materials or enforce limitations on use of the Website or the materials therein. The materials on the Website or otherwise may not be modified, copied, reproduced, distributed, republished, downloaded, displayed, sold, compiled, posted or transmitted in any form or by any means, including but not limited to, electronic, mechanical, photocopying, recording or other means.
.10. Force Majeure
Other Parties accept and acknowledge that Healthvollet shall not be liable for any loss or damage caused to the User as a result of delay or default or deficiency or failure in the Services as a result of any natural disasters, fire, riots, civil disturbances, actions or decrees of governmental bodies, communication line failures (which are not caused due to the fault of Healthvollet or the Third Party Service Providers), or any other delay or default or deficiency or failure which arises from causes beyond Healthvollet’s reasonable control (“Force Majeure Event”). In the event of any Force Majeure Event arising, Healthvollet, depending on whose performance has been impacted under the Terms of Use, shall immediately give notice to the Other Party(s) of the facts which constitute the Force Majeure Event.
11. Governing Law and Dispute Resolution
These Terms of Use and any contractual obligation between the Parties will be governed by the laws of India, without reference to the conflict of laws principles. Any legal action or proceeding related to Other Party(s) access to, or use of, the Website or these Terms of Use shall be subject to the exclusive jurisdiction of the courts at New Delhi. All disputes will be subject to arbitration at New Delhi in English by a sole arbitrator appointed by Healthvollet under the Arbitration and Conciliation Act, 1996.
1. Survival
Even after termination, certain obligations mentioned under Covenants, Liability, Indemnity, Intellectual Property, Dispute Resolution will continue and survive termination.
2. Severability
If any provision of these Terms of Use is deemed invalid, unlawful, void or for any other reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any of the remaining provisions.
3. Waiver
No provision of these Terms of Use shall be deemed to be waived and no breach excused, unless such waiver or consent shall be in writing and signed by Healthvollet. Any consent by Healthvollet to, or a waiver by Healthvollet of any breach by Other Parties, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.

The headings and subheadings herein are included for simplicity,convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of these Terms of Use.
